A federal judge has scaled back her order overturning a 10 percent cut in Medi-Cal fees to thousands of doctors and other health professionals.

The ruling spares the state from tens of millions of dollars of reimbursements over seven weeks and requires repayment only for services performed on or after Aug. 18.

U.S. District Judge Christina Snyder of Los Angeles had ruled Aug. 18 that the fee reductions threatened health care for many of Medi-Cal's 6.6 million low-income patients and appeared to violate federal standards for access to high-quality medical services. She ordered state officials to reimburse health care providers dating back to July 1, when the cuts took effect.

But after lawyers for the Medi-Cal program argued that the Constitution shields states from retroactive damage awards, Snyder revised her ruling Aug. 27 to eliminate the back payments and require full fees at pre-July 1 levels only from Aug. 18 onward. The state has asked a federal appeals court to overturn the entire ruling, arguing that federal law does not entitle Medi-Cal providers or patients to challenge fee levels in court.

State lawmakers approved the fee cuts in February, effective with the start of the fiscal year July 1. The Legislature remains in a partisan deadlock over the 2008-09 budget, which has a $17.2 billion deficit.

State officials had estimated that Snyder's original injunction - which covered fees to doctors, dentists, pharmacists, adult day health centers and clinics - would cost California $500 million a year. By that estimate, her Aug. 27 ruling would save the state $65 million. Because the fee reduction also applies to the federal government's 50 percent funding of Medi-Cal, the loss to health care providers would total $130 million.

"It's a blow to providers' ability to take care of the Medi-Cal population ... and a blow to the effort to insure that poor Californians have access to health care," Ned Wigglesworth, spokesman for the California Medical Association, said Wednesday.

Noting that many doctors already shun Medi-Cal because of low fees, Wigglesworth said, "If the state continues to insist on cutting health care during times of budget problems, providers are going to be less willing to participate."

Lynn Carman, lawyer for pharmacists, patients and community organizations that challenged the cuts in Medi-Cal prescription drug fees, said he would ask the appeals court to reinstate Snyder's original ruling and require reimbursement from July 1 onward. He renewed his accusation that state officials are dragging their feet on complying with the injunction, a subject of a hearing scheduled before Snyder on Friday.

Norman Williams, spokesman for the Department of Health Care Services, said the department has told its employees and contractors to "fully comply with the order" unless the judge agrees to suspend the injunction during the state's appeal.

Samadi, M.D., Chief of Robotics and Minimal Invasive Surgery in the Department of Urology at Mount Sinai on August 13, 2008 at 5:00 p.m. EST. Dr. Samadi will explain case video of a robotic radical prostatectomy using the da Vinci S HD Surgical System. He will conduct a live question and answer session with viewers on the effectiveness of open, laparoscopic, and robotic prostate surgeries. As a surgeon, robotic surgery enables me to remove the cancerous prostate from patients and help them return to a normal, healthy life, said Dr. Samadi. Instead of two to three days of hospitalization and two months of recuperation typical with open prostate surgery, robotic surgery patients often go home the next day and resume normal activities within two weeks.
During the webcast, Dr. Samadi will discuss the benefits of a robotic-assisted prostatectomy as compared to open and laparoscopic surgical procedures. Robotic prostate surgery is made possible with highly magnified visual enhancement technology in a bloodless field. This allows for greater precision in cutting and suturing with far less trauma to surrounding tissue, delicate nerve sparing, minimal blood loss, reduced risk of infection, and faster recovery. Patients experience improved clinical outcomes and increased control over their bladders and sexual functions.
Dr. Hall specializes in urologic oncology and open surgical techniques, and collaborates with Dr. Samadi on the treatment of prostate cancer for many of his patients.

The Procedure:
Dr. Samadis robotic prostatectomy technique has evolved over the past 8 years starting with open surgery, moving to laparoscopy and finally to robotic surgery. Instead of making an 8 to 10 incision to remove a 2 prostate gland, Dr. Samadis robotic prostatectomy surgery involves just five small incisions in the patients abdomen, through which extremely fine instruments are inserted along with a miniscule camera that displays magnified two-dimensional images from inside the body onto a screen. The addition of the sophisticated da Vinci system transforms those images into 3D representations, which enables the surgeons hand movements to be scaled, filtered, and incredibly precise. The Centers for Medicare Medicaid Services (CMS), Provider Communications Group, will host the fifth in a series of national provider conference calls on the 2008 Physician Quality Reporting Initiative (PQRI). The Medicare, Medicaid, and SCHIP Extension Act of 2007 (MMSEA) (P.L. 110-173), which was enacted on December 29, 2007, requires that for 2008 and 2009 the Secretary establish alternative reporting periods and alternative criteria for satisfactorily reporting groups of measures. It also requires that for 2008 and 2009 the Secretary establish alternative reporting periods and alternative criteria for satisfactorily reporting quality measures data through registries.

In 2008, eligible professionals may earn an incentive payment of 1.5 percent of their total allowed charges for Physician Fee Service covered professional services furnished during the respective alternative reporting periods based on data submitted via these mechanisms. While TRHCA established a cap on incentive payments for 2007, based on an average per measure payment amount, there is no cap on incentive payments under MMSEA for 2008 and 2009.

These provisions provide increased opportunities for eligible professionals to report PQRI quality measures and the possibility to earn incentive payments for satisfactory reporting.

Seoul – Vietnam and the Republic of Korea (RoK) have agreed to broaden bilateral cooperation in environmental protection which has concerned both governments.
The agreement was reached at the sixth Vietnam-RoK environment ministers’ conference held in Seoul on June 20, where the two countries underscored the importance of increased bilateral environmental cooperation to sustainable development.
Accordingly, the cope of the two countries’ future environmental cooperation will cover the sharing of experiences and information and the transfer of technology related to the protection and treatment of environmental pollution.
The two delegations to the conference also pledged to join efforts at international, regional and sub-regional environment-related forums, exchange viewpoints and consult each other on environment-related issues of mutual concern.
Minister of Natural Resources and Environment Pham Khoi Nguyen, apart from attending the conference, held talks with his RoK counterpart, Lee Maan-ee, affirming that environmental cooperation has been boosted along with the two countries’ mainstream cooperation.
The Vietnamese minister admitted that industrialisation has imposed great challenges to the country’s environment, requiring the undertaking of strategic renewals and breakthroughs and international cooperation.
He said the environment is one of the potential fields to be tapped by both countries, expressing hope for learning from RoK’s experiences in industrialisation.
Since 2004, the Vietnamese and RoK environment ministries have coordinated with related ministries and agencies to carry out many cooperative projects related to the environment.
Apart from signing a number of agreements, the two sides have initiated some big projects, including the project to build an environmental training centre in Vietnam with RoK’s ODA, the project to set up an air environment observing system, and the project to develop an E-manifest system to manage electronic wastes in Vietnam.
